📋 Please read this document carefully before enrolling. By registering for any program, class, camp, event, or activity at Element4 Athletics — whether in person, online, or through a third-party platform — you confirm that you have read, understood, and agreed to all terms and conditions outlined in this document on behalf of yourself and/or your minor child.

SECTION 01

About This Agreement

These Terms and Conditions (“Agreement”) constitute a legally binding contract between you (“Member,” “Participant,” “Parent,” or “Guardian”) and Element4 Athletics LLC (“Element4,” “we,” “us,” or “our”), a Louisiana limited liability company operating at 116 Nolan Rd., Broussard, Louisiana 70518.

This Agreement applies to all individuals who enroll in, attend, or participate in any program, class, camp, open gym, clinic, event, birthday party, private lesson, or facility operated by Element4 Athletics, whether on a recurring monthly basis or as a one-time drop-in participant. If a participant is under the age of 18, the parent or legal guardian enrolling the participant accepts these terms on the participant’s behalf.

By completing registration — online, in person, or through any third-party enrollment platform — you agree to be bound by this Agreement in its entirety. If you do not agree to any provision of this Agreement, do not enroll or participate. Continued participation constitutes ongoing acceptance of the most current version of this Agreement.

Section 02

Enrollment & Registration

Enrollment is subject to availability and is not confirmed until all required registration forms are completed, the non-refundable registration fee is paid, and written confirmation is received from Element4 staff.

Registration Fee

A non-refundable registration fee of $50.00 is required per athlete at initial enrollment. This fee is not applied toward monthly tuition and is not refundable under any circumstance, including withdrawal before the first class.

Required Documentation

Prior to the first day of participation, all families must complete and submit: a signed Liability Waiver, a Medical Information and Emergency Contact Form, a Media Release Form, and this Terms & Conditions agreement. Participation is not permitted until all documents are on file.

Placement & Level Assignment

Element4 reserves the right to place athletes in the class level or team that our coaching staff determines is the most appropriate fit. Placement decisions are made in the athlete’s best interest. Families may discuss concerns with coaching staff, but final decisions rest with Element4 Athletics.

Enrollment for Minors

All participants under 18 must be enrolled by a parent or legal guardian who is at least 18 years of age. The enrolling adult assumes full responsibility for ensuring the minor complies with all Element4 policies.

Section 03

Fees, Payments & Billing

All fees are due on the 1st of each month. Element4 operates on a monthly auto-renewal basis unless a written cancellation request is received in accordance with Section 04.

Late Payment Fee

A late fee of $15.00 will be automatically applied to all accounts with outstanding balances beginning on the 6th of each month. If payment is not received by the 15th, Element4 may suspend the participant’s access to all classes until the balance is paid in full.

Additional Fees — Competitive Teams

Monthly competitive team tuition covers music, choreography, and competition entry fees only. Not included: uniform and apparel, makeup and accessories, travel expenses for away competitions, and optional team merchandise.

Accepted Payment Methods

Element4 accepts [insert accepted methods — credit/debit card, cash, Venmo, Zelle, etc.]. Returned or declined payments are subject to a $25.00 returned payment fee in addition to any applicable late fees.

⚠️ Note: Monthly tuition is charged for the full month regardless of classes attended. There are no pro-rated charges for partial month enrollment except for initial enrollment mid-month.

Section 04

Refunds & Cancellations

All cancellation requests must be submitted in writing via email to element4athletics@outlook.com. Verbal cancellations will not be accepted.

Monthly Classes & Recreational Programs

Written notice must be received by the 20th of the month prior to the next billing cycle. Cancellations after the 20th will result in one final month’s charge. No refunds for the current billing month regardless of attendance. The $50 registration fee is non-refundable.

Competitive Teams

Competitive team tuition is non-refundable once the season begins. If withdrawing, written notice of at least 30 days is required. Families remain responsible for competition fees already paid at time of withdrawal.

Summer Camp

Cancellations made 7 or more days before the first camp day receive a full refund minus a $15 processing fee. Cancellations within 7 days are non-refundable. No refund for days missed once the camp week has begun.

Class Cancellations by Element4

If Element4 cancels a class due to instructor illness, facility issues, or circumstances beyond our control, we will make reasonable efforts to provide a makeup class or account credit. Cash refunds are not guaranteed for individual cancelled sessions.

Medical Withdrawal

In the event of a documented medical condition preventing participation, Element4 will work with the family on a case-by-case basis regarding account credits. A physician’s note is required. This provision does not guarantee a refund.

Section 05

Assumption of Risk

Participation in cheerleading, tumbling, stunting, and related athletic activities involves inherent physical risks including sprains, strains, fractures, dislocations, concussions, and in rare cases, more serious injuries. These risks exist even when activities are properly supervised.

By enrolling, you voluntarily acknowledge and assume all risks associated with participation, including risks from use of athletic equipment, partner or group stunting activities, and physical contact inherent to these sports.

Specific Activity Risks Acknowledged

Risks include but are not limited to: falls during tumbling or stunt activities, contact with other athletes during stunting, equipment malfunction, overexertion, pre-existing condition aggravation, and impact with gymnasium floors. Use of air floors reduces certain risks but does not eliminate them.

Element4 Athletics makes no warranty that participation is free from risk of injury. Our safety protocols and certified coaching staff are designed to minimize risk — but cannot eliminate it entirely. You accept these residual risks as a condition of participation.

Section 06

Liability & Waiver

To the fullest extent permitted by Louisiana law, Element4 Athletics LLC, its owners, operators, coaches, employees, contractors, and agents (collectively, “Released Parties”) shall not be liable for any injury, illness, loss, damage, or expense arising from participation in any Element4 program, class, event, or use of our facility.

Scope of Release

This release includes: injuries occurring during class, practice, competition, or travel to/from Element4 events; injuries resulting from the negligence of coaches, staff, or other participants; property damage or theft; psychological distress; and any injury related to pre-existing medical conditions.

Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising from your or your minor child’s participation in any Element4 program.

⚠️ Important — Parents of Minor Participants: The enforceability of liability waivers signed on behalf of minors varies under Louisiana law. Element4 strongly recommends all families review this section with a qualified attorney before enrolling.

Limitation of Liability

In no event shall Element4’s total liability exceed the total tuition paid by that family in the three (3) months immediately preceding the event giving rise to the claim. Element4 shall not be liable for any indirect, incidental, consequential, or punitive damages.

Section 07

Code of Conduct

Element4 Athletics is committed to maintaining a positive, safe, and encouraging environment for all athletes, families, coaches, and staff. The following standards apply to all participants, parents, guardians, and visitors at all Element4 facilities and events.

Athlete Standards

All athletes are expected to: treat coaches, teammates, and staff with respect; follow all safety instructions from coaching staff immediately; arrive prepared in appropriate athletic attire; refrain from profanity or aggressive behavior; and represent Element4 with integrity at competitions and public events.

Parent & Guardian Standards

Parents and guardians are expected to: support their athlete with encouragement rather than performance pressure; communicate concerns respectfully and directly to coaching staff through appropriate channels — not during class; refrain from coaching from the sidelines; and model the values we teach our athletes.

Social Media Policy

Negative, disparaging, or defamatory statements about Element4 Athletics, its staff, athletes, or families published on social media are grounds for immediate dismissal. Constructive concerns should be communicated directly to info@element4athletics.com

⚠️ Violation of the Code of Conduct — including by a parent or guardian — may result in a formal warning, temporary suspension, or permanent dismissal. No refunds will be issued in cases of conduct-based dismissal.

Section 08

Attendance Policy

Regular attendance is fundamental to athlete development and — in the case of team programs — to the safety and success of the entire group.

  • Recreational classes: Attendance is strongly encouraged every week. Missed classes are not credited or refunded.
  • Competitive team practices (Prep & Elite): Attendance is mandatory. Repeated unexcused absences may result in reassignment or removal from the team roster.
  • Boot Camp (August): Mandatory for all competitive team athletes. Missing without a documented medical excuse may result in removal from the season roster.
  • Choreography Camp (August): Mandatory for all competitive team athletes. The routine cannot be safely set without full team presence.
  • Makeup classes: Element4 does not offer formal makeup classes. Athletes may attend an alternate session at the same level if space permits, subject to coach approval.
  • Holiday closures: Element4 observes major holidays. Monthly tuition is not adjusted for holiday closures. The holiday schedule will be published and communicated via email.

Section 09

Media Release & Photography

Element4 Athletics regularly photographs and records video of classes, practices, competitions, and events for use in marketing materials, social media, website content, and promotional purposes.

Default Media Consent

By enrolling, you grant Element4 Athletics LLC a non-exclusive, royalty-free, perpetual license to photograph, record, and use the likeness, name, voice, and image of you and/or your minor child in any media format — including social media (Instagram, Facebook, TikTok), the Element4 website, and print materials — without additional compensation.

Opting Out

If you do not wish for your child to appear in marketing materials, submit a written opt-out request to info@element4athletics.com at enrollment. Opt-out requests cannot retroactively remove previously published content. Opting out does not affect enrollment status in any way.

Photography by Families

Parents are welcome to photograph their own athlete during classes and events. Photos or videos that prominently feature other families’ children may not be published publicly on social media without those families’ consent.

Section 10

Health, Medical & Emergency

The health and safety of every athlete is our highest priority. The following policies ensure our coaching staff can respond effectively in any medical situation.

Medical Disclosure Requirement

All families must disclose relevant medical history, conditions, allergies, and current medications on the Medical Information Form prior to the first day of participation. This includes asthma, seizure disorders, heart conditions, diabetes, severe allergies, recent surgeries, and any physical limitations. Failure to disclose known conditions may affect Element4’s liability.

Emergency Medical Authorization

In an emergency where a parent cannot be immediately reached, you authorize Element4 staff to seek emergency medical assistance on your or your minor child’s behalf, including calling emergency services and consenting to emergency treatment as required.

Illness Policy

Athletes who are ill — including fever, vomiting, or active infection — must not attend class until symptom-free for at least 24 hours without fever-reducing medication. Element4 reserves the right to send a visibly ill athlete home. Missed classes due to illness are not credited or refunded.

Injury During Participation

In the event of an injury, a coach will administer basic first aid and contact the athlete’s emergency contact. For serious injuries, emergency services will be called. An incident report will be completed for all on-premises injuries. Element4 staff are CPR/First Aid certified but are not medical professionals.

Section 11

Summer Camp Terms

The following additional terms apply specifically to Summer Camp participants. All general terms in this Agreement also apply.

  • Drop-off & pick-up: Drop-off begins at 5:30 AM. Pick-up must be completed by 5:30 PM. Late pick-up will incur a fee of $1.00 per minute after the grace period, payable at pick-up.
  • Authorized pick-up: Only adults listed on the Authorized Pick-Up Form may collect a camper. Photo ID required. Element4 will not release a camper to any unauthorized individual.
  • Food and dietary needs: Families must provide a packed breakfast and lunch daily. Disclose all food allergies on the Medical Information Form. Element4 cannot guarantee an allergen-free environment.
  • Camper belongings: Element4 is not responsible for lost, stolen, or damaged personal belongings. Label all items. Do not send valuables, electronics, or large sums of money.
  • Behavior and dismissal: Element4 reserves the right to dismiss any camper whose behavior poses a risk to others, without refund of remaining camp days. Parents must arrange immediate pick-up.
  • Sunscreen and outdoor activities: Parents are responsible for applying sunscreen before drop-off. Written authorization is required for staff to assist with reapplication.

Section 12

Intellectual Property

All content produced by Element4 Athletics — including the Element4 name, logos, brand marks (Element4, LMNT Elite, Element4 Elite), training methods, class structures, choreography, music compilations, and written materials — is the intellectual property of Element4 Athletics LLC and may not be reproduced or used without express written permission.

Cheerleading Routines & Choreography

Competition routines, music, and choreography created for Element4 competitive teams are the property of Element4 Athletics LLC. Athletes and families may not share or distribute full team routines, music mixes, or choreography recordings — including via social media — without written permission from Element4 management.

Section 13

Privacy & Data Collection

Element4 Athletics collects personal information including names, addresses, phone numbers, email addresses, date of birth, medical information, and payment details for the purpose of administering our programs and communicating with families.

How We Use Your Data

Your personal information is used exclusively to manage enrollment, communicate updates, process payments, and respond to inquiries. Element4 does not sell, rent, or share your personal information with any third party except as required by law or to process payments.

Children’s Privacy (COPPA)

Element4 serves children under 13. In compliance with COPPA, we collect personal information about children only from their parent or legal guardian. Parents may request to review, correct, or delete their child’s information at any time by contacting info@element4athletics.com.

Data Security & Retention

We take reasonable steps to protect personal information from unauthorized access. Athlete records are retained for a minimum of three years following the end of participation for liability and insurance purposes. Medical information is stored securely and accessible only to coaching staff on a need-to-know basis.

Section 14

Termination of Enrollment

Element4 Athletics reserves the right to terminate any participant’s enrollment at any time, with or without prior notice, for any of the following reasons:

  • Violation of the Code of Conduct by the athlete, parent, or guardian
  • Non-payment of fees after the 15th of the month
  • Any behavior that poses a risk to the safety of other athletes, staff, or the facility
  • Harassment, bullying, or discriminatory behavior directed at any person
  • Misrepresentation of medical history or other material information at enrollment
  • Any action that Element4 management determines is incompatible with the culture and values of Element4 Athletics

In cases of conduct-based termination, no refund of current month tuition or registration fees will be issued. Outstanding balances remain due and payable upon termination.

Section 15

Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions.

Informal Resolution First

Before initiating any formal legal proceeding, both parties agree to make a good-faith effort to resolve the dispute informally by contacting Element4 Athletics at info@element4athletics.com and allowing a minimum of 30 days for resolution.

Venue

If informal resolution is not possible, any legal action shall be brought exclusively in the state or federal courts located in Lafayette Parish, Louisiana. You consent to the personal jurisdiction of such courts.

Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

Section 16

Contact & Document Updates

Element4 Athletics reserves the right to update these Terms and Conditions at any time. When material changes are made, enrolled families will be notified via email at least 14 days before the effective date. Continued participation constitutes acceptance of revised terms.
